miaa Guard CVBA (“miaa Guard”) values the privacy of visitors to our websites and individuals whose personal information we receive through the use of miaa Cloudware and related services (“miaa Services”) subscribed to by our customers (“miaa Customers”).

This Privacy Policy applies to personal information that we collect through miaa Guard’s websites and collected through miaa Services. This privacy policy explains how we collect personal information on our websites and through miaa Services, and how we use and disclose that personal information.

This Privacy Policy is incorporated into and is subject to the miaa Terms of Service. Any capitalized terms not defined herein have the meaning set forth in the miaa Guard Terms of Service.

Websites Covered

This privacy policy covers the information practices of websites that link to this privacy policy, including but not limited to, http://www.miaaguard.com. miaa Guard’s websites may contain links to websites operated by third parties. miaa Guard is not responsible for the privacy practices or the content of such other websites. We encourage you to learn about such third parties’ privacy and security policies before providing them with personal information.

Information We Collect

By providing your personal information to our website, you consent to the information handling practices described in this privacy policy. We encourage you to read the section titled “Your Choices” below to understand the choices you have with regard to your personal information.

We collect the following data about users:

  1. information that you voluntarily submit to us (“User-Supplied Information”);
  2. technical data automatically collected from all visitors to miaa Guard’s websites (“Passive Data Collection”);
  3. information we collect through miaa Services; and
  4. information we collect from third party sources.

User-Supplied Information.
We may collect user-supplied information when you choose to provide us with your Personal information via miaa Guard websites, including when you send us an email asking a question, register to attend seminar, submit a form to receive marketing materials or email newsletters, or request any research or whitepapers, including, without limitation, at info.miaaguard.com.

Passive Data Collection.
Like most web-based services, we automatically receive and record information on our server logs from your browser when you use miaa Guard websites and Services. We may use a variety of methods to collect this information. The information that we may collect with these automated methods may include, for example, your IP address, cookie information, a unique device or user ID, browser type, system type, the content and pages that you access on miaa Guard websites or miaa Services, the frequency and duration of your visits to miaa Guard websites or miaa Services, and the “referring URL” (i.e., the page from which you navigated to miaa Guard websites). We may also use cookies on miaa Guard websites and Services to store session validators on your hard drive. If we directly combine any information gathered through passive means with Personal information, we treat the combined information as Personal information under this Privacy Policy. Otherwise, we use information collected by passive means in aggregated forms.

Third Party Sources.
We may also obtain information, including Personal information, from third party sources. This may include aggregated anonymous information or certain Personal information that may be provided to us, including, but not limited to, through third party surveys conducted on our behalf, companies that publish and disseminate press releases on our behalf, social networks providing information about our fans and followers on their platform, and analytics from companies that perform email marketing on our behalf. If we receive personal information from third parties we will handle it in accordance with this Privacy Policy. If we directly combine information from other third parties with personal information that we collect on miaa Guard websites or miaa Services, we will treat the combined information as personal information and handle it in accordance with this Privacy Policy. Additionally, we may use any aggregated anonymous information received by third parties as set forth below under the heading “Aggregate Information and Non-Identifying Information”.

Use of Collected Information

We use personal information to establish and enhance our relationship with you. We may use personal information to operate, provide, improve, and maintain miaa Guard websites and Services, and to develop new products and Services; to prevent abusive and fraudulent use of miaa Guard websites and Services; to personalize and display content on miaa Guard websites; where permitted by applicable law, to send you information, including via email, about our products and Services in which we believe you may be interested; to respond to your inquiries and for other customer service purposes; and for other administrative and internal business purposes.

We may use your e-mail address, including any email address provided at info.miaaguard.com or through miaa Guard websites as set forth in the “Communications and Marketing” section. On miaa Guard websites, we may use passively collected data to: (a) remember your information so that you will not have to re-enter it during your visit or the next time you visit miaa Guard websites; (b) monitor your participation in various sections of miaa Guard websites; (c) customize our Service to you, including by providing you with recommendations; (c) monitor aggregate website usage metrics such as total number of visitors and pages viewed; and (d) administer, operate, and improve miaa Guard websites and our other Services and systems, and to provide Services and content that are tailored to you.

Disclosure of Collected Information

We do not sell or rent email addresses and other personal information that we collect directly through miaa Guard websites. Please be aware, however, that any information that you voluntarily choose to display on any publicly available portion of miaa Guard websites, or on any Service, becomes publicly available and may be collected and used by us or others without restriction. We share your information, including personal information, as follows:

miaa Guard Service Providers

We may provide personal information to third parties for their use in performing internal business functions (e.g., maintenance, security, data analysis, email transmission, CRM, database management services, email marketing, surveys, or data hosting) on our behalf. We require such third parties to agree to only use your personal information in accordance with this Privacy Policy and for no other purpose than to provide us with necessary services.

Legal Requirements

We may disclose personal information if we have a good-faith belief that doing so is required by a subpoena or other judicial or administrative order or otherwise required by law. Additionally, we may disclose personal information where we, in good faith, deem it appropriate or necessary to prevent violation of miaa Guard Terms of Service, or our other agreements; take precautions against liability; protect the rights, property, or safety of miaa Guard, any individual, or the general public; maintain and protect the security and integrity of our services or infrastructure; protect ourselves and our services from fraudulent, abusive, or unlawful uses; investigate and defend ourselves against third-party claims or allegations; or assist government enforcement agencies.

Aggregate Information and Non-Identifying Information.

We may share aggregated information with miaa Customers, prospective customers, partners or the press in order to demonstrate usage of miaa Services, identify industry and advertising trends, and to generate publicity for miaa Services.

Your Choices

You may, as a visitor to our website, choose not to provide us with personal information. You may also, at any time, access your personal information to update, correct, or delete certain personal information about you by contacting us at support@miaaguard.com or at the address set on this page in the “Connect With Us” section.

In addition you may decide not to opt–in, either when you first provide miaa Guard with any personal information, to receive marketing information from miaa Guard about products and services (including our products and services and those of third parties). Please be aware that even if you update or remove personal information that you have provided to us, your personal information may be retained in our backup files and archives for a reasonable period of time for legal purposes.

Communications and Marketing

If you opted in to receive communications from us, including through info.miaaguard.com, we may send you administrative messages and updates regarding your account, updates regarding miaa Guard websites or miaa Services, and, where permitted by applicable law, information regarding our offer, products and services, including, without, limitation, through social media updates, by email and postal mail. If you no longer want to receive commercial email messages, you may indicate your preferences regarding commercial email messages by taking the steps described in such messages. Also, you may indicate your preferences regarding commercial email messages and postal mail messages by contacting us using the information in the “Connect with Us” section on this page.

End User Data

We collect, use, and retain certain information at the direction and on behalf of miaa Customers from individuals (“End Users”) who use Customer’s web services (“End User Data”). miaa Guard has no relationship with such End Users whose End User Data we process on behalf of miaa Customers. We also do not decide how miaa Customers use such End User Data. Even though miaa Services may process End User Data, we do not directly access and use End User Data, except as directed by miaa Customers or required by law.

We may collect and process two types of End User Data:

  1. information that is passed through miaa Services as a result of use of miaa Services including miaa Cloudware, and,
  2. technical data passively and automatically collected from all visitors to pages of a miaa Customer’s website that load miaa Services.

We maintain no rights to use any End User Personal Information transmitted to us on a miaa Customer’s behalf through miaa Services or received from the social networks, except to make miaa Services available to the miaa Customer and/or End User.

We use the information that we collect automatically about the use of miaa Services to facilitate delivery of the miaa Services and, in some cases, for internal reports. Additionally, some of the information collected is used in customer reports. Such customer reports may contain both passively-collected information and End User Personal Information.

If you are a user of one of miaa Customers’ web services, and you want to edit or delete any information captured about you by those Customer’s web services, you should contact the miaa Customer directly.

EU Privacy

miaa Guard complies with the EU General Data Protection Regulation (“GDPR”), as set forth by the EU regarding the collection, use, and retention of personal information obtained from European Union member countries.

We collect, in accordance with the GDPR principles, the categories of information described in the sections “Information We Collect” and “End User Data”. We process personal information about website users for the purposes described above.

The GDPR principles provide individuals located in the EU whose personal information we process with the right to access their personal information in order to review, correct, amend or delete information processed under the Principles. EU individuals who use our websites and would like to access their personal information may contact miaa Guard at support@miaaguard.com or at the address set forth in the “Connect with Us” section.

EU End Users whose personal information we process, as a data processor on behalf of a miaa Customer, should first contact miaa Customer, who is the controller of your personal information, to access their personal information. miaa Guard will work with miaa Customer to provide End Users the necessary access about what personal information is processed.

As described in the “Disclosure of Collected Information” section above, we may transfer personal information from the EU to third parties. We contractually require third parties to whom we transfer personal information to provide the same level of protections as the Principles. miaa Guard remains responsible for the personal information we receive and transfer under GDPR principles. In accordance with our legal obligations, we may also transfer, subject to a lawful request, personal information to public authorities for law enforcement or national security purposes.


The security of your information is important to us, including, but not limited to, the personal information collected via miaa Guard websites and miaa Services. We use reasonable security measures to protect against the loss, misuse, and alteration of Personal information under our control, both during the transmission and once we receive it. This includes, but is not limited to, the use of firewalls and encryption. Although we make good faith efforts to maintain the security of such personal information, no method of transmission over the Internet or method of electronic storage, is 100% secure and we cannot guarantee that it will remain free from unauthorized access, use, disclosure, or alteration. Further, while we work hard to ensure the integrity and security of our network and systems, we cannot guarantee that our security measures will prevent “hackers” or other unauthorized persons from illegally accessing or obtaining this information.

If we learn of a security breach involving your personal information, we may attempt to notify you electronically so that you can take appropriate protective steps. By using miaa Guard websites or providing personal information to us, you agree that we can communicate with you electronically regarding security, privacy, and administrative issues relating to your use of miaa Guard websites. If a security systems breach occurs, we may post a notice on our homepage (www.miaaguard.com) or elsewhere on miaa Guard websites and may send an email to you at the email address you have provided to us. Depending on where you live, you may have a legal right to receive notice of a security breach, involving your personal information, in writing. This notice paragraph applies to users of miaa Guard websites and miaa Customers who use miaa Services on their third party websites only. Should there be a breach that affects End Users of miaa Customers, miaa Customers will be responsible for disseminating notice of such a breach to those End Users.

Complaints and Dispute Resolution

Individuals who have questions or complaints about how we process their personal information may contact us at support@miaaguard.com. We will work to resolve your issue and respond no later than 10 days of receipt. Individuals may also submit complaints through their local Data Protection Authority. Finally, if we are unable to resolve any complaints through any of the above methods, an individual may invoke binding arbitration in accordance with the GDPR.

Updates to this Privacy Policy

We may occasionally update this privacy policy. If we do, we will change the “effective date” at the top of the privacy policy. Before making any update that would make this privacy policy materially less restrictive in our use or disclosure of personal information collected prior to the update, we will provide prior notice of the update by posting notice on our website at the top of the then-current privacy policy at least 30 days before the effective date of the update. We encourage you to periodically review this privacy policy to stay informed about our collection, use, and disclosure of personal information. Your continued use of our website constitutes your agreement to our then-current privacy policy.
